I AUTHORISE Canine Essentials to administer or seek First Aid and resuscitative care for my dog(s) as determined appropriate by Canine Essentials and I agree to indemnify and hold harmless Canine Essentials for all and any results thereof. I understand that full payment of the service is to be paid at the time of the agreed training session start time. Non-payment of fees may result in cancellation of future sessions and active collection of outstanding fees via debt collectors and/or the Australian legal system by Canine Essentials recovery of monies owed will be at the client’s expense. Canine Essentials abides by the ACCC “Consumer Rights & Guarantees”. Refunds may be issued for unconsumed Services under some circumstances.

AGREE – I agree to allow Canine Essentials to use my name, dogs name and any photographs, sound and film recordings taken of whilst acting in my capacity as applicant, student or graduate of Canine Essentials for any promotions, initiatives to the media and to the general public, future training material, reports to official bodies and other documentation.

I understand that Canine Essentials trains dogs and handlers for either those seeking to prepare for Assistance Dog accreditation with State or Territory Government’s, or, those seeking training under the Commonwealth Disability Discrimination Act (1992; Section 9.2.c). I will advise Canine Essentials Behaviourists at the commencement of training so the course outline can be individualised to my requirements.

I am solely liable for any damage to persons, premises, or facilities including places of public accommodation, public conveyances or transportation services, common carrier of passengers, places of housing accommodations, and places of employment caused by that Assistance Dog or Assistance Dog in Training.

I (or the alternate handler) shall keep the dog properly harnessed or leashed. I understand that failure to properly harness or leash the dog is entitled to maintain a cause of action for damages in a court of competent jurisdiction under the same laws applicable to other causes brought for the redress of injuries caused by animals.

I understand that I will be contacted weekly throughout the duration of the Assistance Dog Training program by Canine Essentials Behaviourist’s.

I understand that I must contact Canine Essentials fortnightly for 6 months following successful completion of the Public Standards Assessment to discuss preparation for Assistance Dog accreditation with State and Territory Governments and to also discuss my dog’s progress following the completion of the program. This is complimentary (free) service offered by Canine Essentials. I understand that failure to make contact may be grounds to cease remaining a Canine Essentials client.

*I understand that the course length is an indication only. *Depending on my Dog’s progression, further training sessions may be required and I will be liable for extra costs incurred.
*I understand that my Dog must be re-assessed yearly and must involve veterinary certification in addition.
*I understand that my Dog must have an annual C5 vaccination and remain current in their vaccination status to remain in the Canine Essentials Assistance Dog Owner Trained Program.

Canine Essentials will aim to create a secure, safe and friendly environment for the training of my dog. Canine Essentials will train my dog in a responsible professional way and will offer me advice on how to maintain the level reached in the course. Canine Essentials is not, however responsible for incorrect assertions.

This means that Canine Essentials expressly disclaims, and I expressly release Canine Essentials from, any and all liability whatsoever for any controversies, claims, suits, injuries and/or damages arising from and/or in any way related to: any inaccuracy, untimeliness or incompleteness regarding any and all sessions held with Canine Essentials and/or misstatements or misrepresentations made by Canine Essentials.

I understand that attendance either in my home or at another location including the business premises of Canine Essentials that at any dog training session held by Canine Essentials may pose some risk to myself, members of my family, my guests, and my dog.

I expressly assume the risk of any damage or injury to myself, my dog, and/or any minors attending a dog training session with me incurred as a result of a dog training session conducted by or on behalf of Canine Essentials.

The Behaviourist/Trainer agrees to exercise due and reasonable care of the Dog while at agreed upon locations. However, the Behaviourist/Trainer is not liable for loss or damage from disease, death, running away, theft, fire, injury to persons, other dogs, or property by the Dog during or after the term of this Agreement.

The client agrees to pay all resulting losses and damages suffered or incurred, and to defend and indemnify the Behaviourist/Trainer, her employees and agents from any resulting claims, demands, lawsuits, losses, costs or expenses, including attorney fees.

Cases of canine aggression may be the result of a variety of factors, both genetic and environmental. I understand that many but not all cases of aggression do respond to established behaviour modification protocols with diligent observation of the training regime.

I acknowledge that while Canine Essentials will do their best in every case, they cannot control the everyday factors which may influence the behaviour of the dog. Accordingly, in consideration of my participation in the training session or sessions conducted by or on behalf of Canine Essentials , on behalf of myself and any minors attending the training session(s) with me * Continued

Waive, release, and agree to hold harmless Canine Essentials  and any and all of their employees, agents, insurers, and successors from any and all causes of actions, claims, demands, losses, injuries, and damages of any kind which may be sustained by me or my dog in connection with the training session. I understand that am responsible for the behaviour of any minors attending with me.

Section 3: In cases of suspicions of dog abuse/neglect etc., breach of the Animal Cruelty Act (varying states) or the RSPCA will be notified immediately.

POLICIES: I agree to abide by Canine Essentials Policies and Procedures. I acknowledge that I have read and understood relevant Policies and Procedures that are available at: http://www.canineessentials.com.au/company/policies/ I understand that Canine Essentials may make changes to Policies according to Industry Standards and I will undertake to check this link on a 3 monthly basis to be aware of any new changes to policies.

I further agree to adhere to all specific laws pertaining to dogs and agree to abide by Council, State and Federal law while attending training sessions with Canine Essentials.

I understand that the Director of Canine Essentials, Dr. Geller, is a Dr. in Nursing and Registered Nurse. As such, she is a Mandated Reporter and must comply with the Children’s Protection Act (1993) AT ALL TIMES even while acting in the capacity as a Canine Behaviourist.

A. I understand that Canine Essentials are Force Free trainers and will abide by a Force Free Training Methodology. This includes abiding by the Prevention of Cruelty to Animals Regulations (2008) and also, refraining from using banned equipment as outlined in Canine Essentials Policies. Further, I understand by using banned equipment I may cease to remain a client of Canine Essentials and there will be no refunds issued under these circumstances.

B. This means that I understand that dog training equipment such as shock collars, prong collars and correction (choke) chains are prohibited and using this equipment is against Canine Essentials policy. Other banned equipment can be found here: http://www.canineessentials.com.au/company/policies/

C. This can exacerbate aggression and is considered inhumane. Therefore i will not use this equipment when attending a training session either in my home or at another location including the business premises of Canine Essentials.

D. This means that I cannot request a refund even under the ACCC Guidelines even if it meets the legal elements of a refund being issued under the ACCC. In plain language, a refund cannot be issued should a client choose to use banned equipment that is in breach of Australian legislation. One such example would be the use of “Prong Collars” in certain states.

A. The Behaviourist/Trainer will make every reasonable effort to help the Client achieve training and behaviour modification goals but makes no guarantee of the Dog´s performance or behaviour as a result of providing professional dog behaviour consultation.

B. The client understands that he/she and members of the household must follow the Behaviourist/Trainer´s instructions without modification, work with dog daily as recommended, and constantly reinforce training being given to dog.

The Behaviourist/Trainer agrees to provide private lessons for Client and the Dog on a lesson-by-lesson basis, the goal being to teach Client how to train and work with the Dog. These lessons will take place at Client’s home, public venue or class situation.

I further understand that Canine Essentials cannot guarantee success in training my dog and acknowledge that in reality, canine training takes place throughout a dog´s and handlers lifetime. In conjunction with Canine Essentials I will make all reasonable effort to attain the training goals that have been agreed upon with Canine Essentials.

I understand that the recommendation of any other product or service is not a guarantee of my satisfaction with that product or service.

I authorise Canine Essentials to enter my home during agreed upon days and hours for the purpose of training my dog.

I authorise Canine Essentials to take my dog off my property during the agreed upon days and hours for the purpose of training my dog.

I understand that it is my responsibility to implement what is covered in the training sessions and agree that without training and proper reinforcement, my dog will most likely not learn the desired behaviour.

I acknowledge that I have provided Canine Essentials a complete and accurate history of the dog/s enrolled in training with Canine Essentials and undertake to advise Canine Essentials should any further relevant information arise before the next training session.

Must be returned prior to the next level being issued. Returning the manual is to be at the Client’s expense. Copying is strictly forbidden, as is distribution/sharing.

These may be expected to be purchased in certain instances. If a Client ceases their relationship with (or vice versa), these will be expected to be returned to Canine Essentials and the Client will be refunded 75% of the cost of the purchase price. Returning these is to be at the Client’s expense.

Minors attending training sessions with Canine Essentials must be supervised by a responsible adult at all times.

A: Children are permitted to handle the dog over the age of 16 years of age by themselves, provided a responsible adult aged over 18+ years is within the immediate vicinity. This is however determined as to their capabilities and other factors. If unsure, please consult with the Director of Canine Essentials who will make a determination.

B: Children under the age of 16 are encouraged to participate in training sessions, but must be directly supervised by an adult (over the age of 18). Children must be well-behaved and not disrupt sessions.

C: If a child is no longer able to attend due to disrupting the session, parents/guardians will be notified in writing via e-mail. It is the parent´s/guardian´s sole responsibility to make arrangements for child care in order for training to continue. In this instance, if suitable child care cannot be arranged, then then please refer to services refund policy for a suitable remedy.

Canine Essentials reserves the right to ask person/s attending training sessions/presentations etc. to leave if their behaviour is deemed inappropriate by Canine Essentials.

In certain instances, you may require assistance with aggressive behaviour/s being exhibited in your dog/s. Canine Essentials can assist you in dealing with these behaviours. However, regardless of training techniques, aggressive behaviours may not be eliminated in all cases. Accordingly as an owner, you are ultimately responsible to ensure that your dog/s does not cause harm.

I certify that I am the owner of the above-mentioned dog/s and that I have sought behavioural counselling for my dog/s on decreasing its/their aggressiveness. I understand that aggression by dogs can cause injury, including fatal injury, to other animals, to other people, and to me. I understand that treatment for aggressive behaviour is not a guarantee that the aggression will be successfully controlled, and that it is impossible to ensure that my dog/s will not cause harm in the future.

I understand that the only way to ensure absolutely that my dog/s will never cause harm in the future is to euthanise it/them (end its life). I understand if I do not euthanise my dog/s, it will be my responsibility to take appropriate precautions to prevent my dog/s from causing harm to others. These precautions may include, but are not limited to: [Cont]…

Informing persons near my dog/s of it’s/their tendency for aggressive behaviour, keeping it/them on a leash, muzzling it/them, using a head collar, and/or keeping it/them restrained behind doors, gates or fencing.

I also understand that it is my responsibility to be aware and comply with all relevant ordinances concerning aggressive dogs, as well as any by laws or act that specifically applies to my dog/s. Finally, I understand that should I choose not to euthanise my dog/s and it/they cause harm in the future, I may be held liable for such harm.

I hereby certify that I have read and understood the above and that I am signing this authorisation with a full understanding that the treatment given by my dog/s may not eliminate it/their aggressive behaviour.

In signing below, I acknowledge understanding the content of this Training Contract in its entirety; that my responses are true; and agree to the terms herein. I understand this Release is necessary to minimise the risk of injury, illness and for the safety of all involved while in attendance, in my home or on the property of Canine Essentials.

I understand that should the dog cause injury to another dog or person during or after the period of this Acknowledgement, I am liable for the damage and will not hold the Behaviourist/Trainer, the employees of Canine Essentials, or their agents responsible. This Services Contract supersedes all prior discussions, representations, warranties and agreements of the parties, and expresses the entire agreement between Client and Trainer regarding the matters described above.

The parties confirm that, except for that which is specifically written in this Training Contract, no promises, representations or oral understandings have been made with regard to the Dog or anything else. The Client acknowledges that the Behaviourist/Trainer has not represented, promised, guaranteed or warranted that the Dog will never bite, that the Dog will not be dangerous or vicious in the future, that the Dog will not exhibit other behavioural problems, [Cont..]

or that the results of the training will last for any particular amount of time. This Training Contract may be amended only by a written instrument signed by both Client and the Behaviourist/Trainer. This Training Contract is binding upon the Client, spouse of Client, and children of Client. the Client and the Behaviourist/Trainer regarding the matters described in this document.
The parties confirm that, except for that which is specifically written in this Training Contract, no promises, representations or oral understandings have been made with regard to the safety of the child or adult or anything else.

Without limiting the generality of the foregoing, the Client acknowledges that the Behaviourist/Trainer has not represented, promised, guaranteed or warranted that they will NEVER receive a dog bite or be otherwise injured by a dog. This Training Contract may be amended only by a written instrument signed by both the Client and the Behaviourist/Trainer.

I consent to the fees charged by Canine Essentials and understand that they are non-refundable subject to those terms stipulated by the Australian Competition & Consumer Commission “Consumer Rights & Guarantees”. Further, I understand that “no-shows” and cancellations (48 hours’ notice is required) count as sessions. I understand that packages agreed on contain sessions and that these sessions must be completed within a specific time frame.

If fees are not paid, this may result in cancellation of future sessions and active collection of outstanding fees via debt collectors and/or the Australian legal system by Canine Essentials. Recovery of monies owed undertaken by Canine Essentials will be at my expense.
I undertake to train with my dog as recommended by Canine Essentials and I understand that there are no guarantees as to the dog´s performance.

This release and terms herein shall remain in effect until nullified or superseded in writing and continued attendance without execution of new annual release serves to confirm as agreement in full with all modifications therein, whether known or unknown.
